This afternoon, Danya joined the American Bar Association for a discussion on “The Trump First Amendment Casebook.” Alongside First Amendment experts Ben Wizner, Catherine Ross, and Josh Blackman, Danya took part in a conversation which addressed topics ranging from when speech crosses the line from protected political dissent into unprotected incitement to leaking classified information a-la Mar-a-Lago.
Danya’s insight was especially illuminating regarding gag orders. With years of experience as a trial lawyer, Danya walked the audience through the legal contours and prudential balancing questions a judge must address when deciding whether to issue a gag order on a criminal defendant.
